These Terms of Service ("Terms") govern your access to and use of the Trust Cryptocurrency Card services, including our mobile application, website at trust-card.space, virtual and physical payment cards, and all related services (collectively, the "Service") provided by Tri-County Trust Company., a company registered in USA ("Company", "we", "us", or "our").
By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
The Service is not available to persons located in jurisdictions where the use of cryptocurrency payment cards is prohibited by applicable law. You are solely responsible for ensuring your use of the Service complies with all laws applicable in your jurisdiction.
You may not use the Service if your account has been previously suspended or terminated by us for violation of these Terms.
To use the Service, you must create an account by providing accurate and complete information including a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us immediately at security@trust-card.space if you suspect unauthorized access to your account. We are not liable for any losses resulting from unauthorized access caused by your failure to safeguard your credentials.
You may not create more than one personal account. Creating multiple accounts to circumvent spending limits, verification requirements, or account restrictions is strictly prohibited and will result in permanent termination of all associated accounts.
In compliance with anti-money laundering (AML) and know-your-customer (KYC) regulations, we may require you to verify your identity before accessing certain features or spending limits. Verification requires submission of a valid government-issued photo ID and a selfie.
We reserve the right to request additional documentation at any time. Failure to provide requested documentation within the specified timeframe may result in suspension of your account or card.
By submitting identity documents, you confirm they are genuine, unaltered, and belong to you. Submitting fraudulent documents is a criminal offence and will be reported to the appropriate authorities.
Upon successful registration, we will issue you a virtual card. Physical cards are available on request and subject to applicable fees. Both card types are issued under license and are subject to the rules of the applicable card network (Visa or Mastercard).
Your card is personal and non-transferable. You must not allow any other person to use your card or card details. You are responsible for all transactions made using your card.
We reserve the right to decline any transaction that we reasonably believe violates these Terms, applicable law, or poses a fraud risk. We are not liable for any losses arising from a declined transaction.
Spending limits apply to all accounts. Standard accounts have lower limits which can be increased upon successful identity verification. Business accounts are subject to separate limits as specified at the time of business account creation.
When you make a payment using the Trust Card, your cryptocurrency is converted to fiat currency at the real-time market rate at the moment of the transaction. We do not guarantee any specific exchange rate.
Cryptocurrency markets are highly volatile. The value of your holdings can decrease significantly in a short period. You acknowledge and accept this risk. We are not responsible for any losses resulting from adverse price movements between the time you load your wallet and the time you make a purchase.
A conversion fee is applied to each transaction. The current fee schedule is available in the app. We reserve the right to modify fees with 30 days' notice to users.
You agree not to use the Service for any of the following purposes: illegal activities of any kind; money laundering, terrorist financing, or other financial crimes; purchasing illegal goods or services; evading taxes or financial reporting obligations; circumventing sanctions or export controls; engaging in market manipulation or fraudulent schemes; unauthorized access to computer systems; and any activity that violates the rules of the applicable card network.
We reserve the right to immediately terminate your account and report your activity to relevant authorities if we have reason to believe you are using the Service for any prohibited purpose.
Our complete fee schedule is published in the app and on our website. Fees include conversion fees applied at the time of purchase, ATM withdrawal fees, physical card delivery fees, and fees for certain currency exchanges. We do not charge monthly account maintenance fees.
We reserve the right to introduce new fees or modify existing fees. We will provide at least 30 days' advance notice of any fee changes via email and in-app notification.
You may close your account at any time by contacting us at support@trust-card.space. Upon account closure, any pending transactions will be completed and your card will be cancelled.
We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms, suspected fraudulent or illegal activity, failure to pass identity verification, or at our discretion. We are not liable for any losses resulting from account termination where permitted by law.
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount of fees you paid to us in the 12 months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of Malta and the European Union. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Malta.
We may update these Terms from time to time. We will notify you of material changes via email and in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and close your account.
